New Tip Site for Reporting Suspected Worker Misclassification in New Hampshire

Posted by Liz Greene

New Hampshire has jumped into the forefront of my contingent workforce news world by launching a tip-off website for the reporting of suspected misclassification of workers as independent contractors. The inter-agency Task Force for the Misclassification of NH Workers website now has a quick and easy form launched just last week where workers, citizens, agencies, and businesses can report suspected improper classification of employees and independent contractors.

The NH Task Force was created last year and features support from the Department of Labor, the Department of Employment Security, the Department of Revenue Administration, and the Department of Insurance. New Hampshire is just one state among many that have created such cooperative task forces for the purposes of sharing information and addressing the growing problem of worker misclassification.

If your New Hampshire business is misclassifying employees as contractors, or someone might have reason to think that you are, it is certainly time to sit up and take notice, and review your worker classification practices with an outside expert. If you're outside of NH, you're still exposed. Every state has its own enforcement approaches, and on the Federal level there are at least half a dozen agencies interested in cracking down on this issue. [See our recent blog post on the IRS's decision to audit 6000 companies for worker misclassification over the next three years.]

My advice? Do your own audit before the task force does it for you.

Even if you think your workers are satisfied with their status, your competitors might see an opportunity: blowing the whistle on workforce fraud and abuse in New Hampshire is now quick, easy and fun for the whole family.
